Privacy Notice for Inquiries

Aureada CPA Law Firm ("the Firm", "we") respects your privacy. This notice explains how we handle the personal information you give us when you contact us through our website, by email, or through our Client Information Form. We follow the Data Privacy Act of 2012 (Republic Act No. 10173) and its implementing rules.

1. What we collect

  • Your name, email address, phone number and address.

  • If you write for a company: the company's name and address, and its authorized representative.

  • The details of your concern, and any documents you choose to send.

Please do not send tax returns, government IDs, financial statements or other sensitive documents until we ask for them. We ask only after we finish our conflict check.

2. Why we use it

 

We use your information only to:

  • reply to your inquiry and schedule a consultation;

  • check that we have no conflict of interest before we act for you;

  • prepare a proposal or engagement letter if you ask for one;

  • keep a record of inquiries as the law and our professional rules allow.

 

We do not sell your information or use it for advertising.

 

3. Our legal basis

  • We use your information with your consent, and because it is needed to act on your request before any engagement (RA 10173, Sec. 12(a) and (b)).

  • If you send sensitive personal information, we use it with your consent, and only as needed to protect or defend legal rights and claims (Sec. 13(a) and (f)).

 

4. No lawyer-client relationship yet

 

Sending an inquiry does not make you our client. That relationship starts only when you and the Firm sign an engagement letter. Until then, please do not treat any reply as legal advice.

5. Who helps us handle your information

 

We use these service providers:

  • Wix, for our website and inquiry forms;

  • Google Workspace, for email, forms, files and calendar;

  • Zoom, for online consultations;

  • Anthropic (Claude), an AI service we use to sort inquiries and prepare internal drafts for our lawyers and staff to review;

  • Intuit QuickBooks, for billing, only if you engage us.

These providers may store data outside the Philippines. They must keep it secure and use it only for our services. A lawyer or staff member reviews every message before it is sent to you.

6. How long we keep it If you do not engage the Firm:

  • Sensitive documents (such as tax returns, IDs and financial statements) are deleted 90 days after your inquiry is closed.

  • Your full inquiry record (emails, form answers, notes) is deleted 1 year after your inquiry is closed.

  • A short conflict record (your name, your company, names of other parties you mentioned, type of matter, and dates) is kept for 5 years, so we can avoid conflicts of interest in the future.

If you engage the Firm, your file is kept under your engagement letter and the law. We do not delete records while a dispute, complaint, or court or government request is pending.

7. Your rights Under RA 10173, you may:

  • be told how we use your information;

  • ask for a copy of it;

  • ask us to correct it if it is wrong or outdated;

  • object to our use of it, or ask us to stop using, block or delete it, when the law allows;

  • get a copy in a common electronic format (data portability);

  • complain to the National Privacy Commission (privacy.gov.ph) and claim damages when the law allows.

8. How we protect it

 

Only the lawyers and staff who need your information can see it. It is kept in secure, password-protected systems.
